injuries.  Contrary to what many in the United Kingdom would believe,  the laws relating to the threshold requirements for bringing or instituting a personal injury matter in Florida are higher than in the UK.

In considering whether you may have a
personal injury claim to pursue in Florida
it is important to first look at
what constitutes a personal injury?
   When we speak of a personal injury, we are talking about an injury to your body, your mind or your emotions.  For example, an injury to your personal  property is not a personal injury.  Personal injury does of course cover broken bones suffered in a
collision
, injury caused to your body due to
physical harm by another
and it may include
psychological and/or emotional injury
inflicted upon you.

Personal injuries often arise due to the
negligence of others
.  Where someone has suffered a personal injury due to the fault of a person or business, the law may hold that person or business legally responsible for damages suffered and order that such person or business pay damages or
compensation
to you.

By way of example, while many types of personal injury cases can be brought in the UK, it is only in those cases in which a claimant has suffered a
permanent  or significant injury
, that a claimant is entitled to any damages for
pain and suffering

loss of enjoyment of life

emotional anguish
, which can be substantial aspects of a claim. Basically this means that if it is found that a claimant did not suffer a permanent or significant injury, then under Florida law the claimant would only be entitled to
out-of-pocket medical expenses
and lost income actually suffered in the past, and that income which would be lost in the future.  For claimants whose medical expenses are paid by a national health service or health insurance, there may therefore be no damages to collect if it is found that the claimant did not suffer a permanent or significant injury.

It is common following the occurrence of a personal injury that the person or business legally responsible for causing the damages will contact their insurers who will seek to quickly investigate the matter and, if there were injuries, look for ways to limit their financial liability. It is their objective to try to settle or resolve a claim as quickly and cheaply as possible.  The insurance companies will normally assign an insurance adjuster to your case who may request that you give them a recorded statement of your version of the events.  Be very careful when giving information that can be used to weaken your case.  Particularly important is to be aware that not all injuries manifest themselves right away.

The compensation that you are entitled to in a personal injury claim depends on several factors.  These may include the type of accident, the nature of your injuries, and whether it affects your ability to work.  If you don’t currently hold a job due to retirement or other circumstances, if your injuries preclude you from doing every day tasks or activities that you enjoy, you may be compensated for the loss of enjoyment of life.
